Welcome to Assessment.com ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, software, tools, services, and platform (collectively, the"Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

  1. ELIGIBILITY

You must be at least 13 years of age to use the Service. If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian's consent.

  1. USE OF SERVICE

Assessment.com offers assessment tools, tests, surveys, and forms (collectively, "Assessments") for individuals and companies. Users may:

  • Take Assessments, (including Surveys, Tests, quizzes etc.) for personal development or understanding.
  • Send Assessments for recruiting, screening, self exploration, information gathering etc.
  • Create, list, and offer or sell Assessments on the Assessment.com Marketplace.
  • Purchase premium Assessments from other creators on the Marketplace.
  • Utilize the MAPP (Motivational Appraisal of Personal Potential) Assessment
  • Create Surveys, contests of skill, etc.

Marketplace & Private Sellers. If you list Assessments for sale (Privately or on Marketplace), you are solely responsible for customer service, including returns, refunds, and compliance with applicable consumer‑protection laws. Assessment.com alone decides if your assessment or test will appear on the marketplace. If decline you still have the right to offer it for a fee privately.  You will receive the amounts collected from purchaser’s minus (i) third‑party merchant‑services fees and (ii) Assessment.com Marketplace fees: Marketplace revenue starts with a 70 / 30 split (creator / platform). As your monthly sales hit higher volume tiers, the creator’s share rises on a sliding scale Monthly sales (rolling 30-day total) Creator / Platform split

Monthly Sales:

Tier 1: $0 – $ 999.00, 70 / 30

Tier 2: $1,000 – $ 4,999, 75 / 25

Tier 3: $5,000 – $ 9,999,   80/ 20

Tier 4: $10,000–$19,999,   85/15

You are responsible for any activity that occurs through your account. Payments from your Assessment sales will be available to you within 48 hours after the chargeback window from the credit card company has been satisfied.  Any disputes or chargeback after that period remain your responsibility.

  1. DATA COLLECTION AND USE

Assessment.com collects and uses data in accordance with our (Privacy Policy/Link]. By using the Service, you consent to the collection, use, and sharing of information as described therein.  Assessment.com also utilizes cookies to help with the user experience and website functionality.

User Data:

  • Individuals who take Assessments provide data ("Assessment Data") that may include personal, psychological, social, educational, and behavioral information. Additional data may be provided or collected based on the test, assessment, survey or other use.
  • If you are taking an Assessment administered by a third party (e.g., an employer, coach, school, etc.), the registration data you submit as well as the scores and/ or results will be accessible both to that third party and to Assessment.com for api, hosting, analytics, grading, counseling, consulting and other support purposes.
  • We are not responsible for the use, storage, or misuse of data by third‑party administrators once they receive it.

Enterprise/Third-Party Usage:

  • If you are a company or organization using our platform to distribute Assessments, you are solely responsible for your handling of the data you collect from your participants.
  • You represent and warrant that you have obtained all necessary rights and consent from your users.
  • You represent and warrant that you will protect customer data and respect the customers requests should they want you to delete their data or unsubscribe from your communications.

Payment Processing and Financial Data: Assessment.com does not collect or store your full credit card, debit card, or bank account information. All payments to us and payouts from us are processed by third party payment providers such as Stripe or other similar services (“Payment Processors”). When you make a purchase on the platform or when you receive payments from us (including, without limitation, creator, affiliate, or referral payouts), you will be required to set up or connect your payment or bank details directly with the applicable Payment Processor, which will store and secure that information in accordance with its own privacy and security practices. We only receive limited information from the Payment Processors that is necessary to confirm payment status, manage your account, and comply with applicable law, and we are not in possession of, and are not responsible or liable for, any bank account, card, or other financial information you provide to the Payment Processors.

Data Availability and Third Party Data Sources: While we take reasonable steps to maintain the availability and integrity of the Assessment.com platform, you acknowledge and agree that we are not responsible for any loss, deletion, corruption, or failure to store any content, data, assessments, reports, or other materials that you or your users submit to or generate through the platform. You are solely responsible for maintaining your own backup copies of any data that is important to you. In addition, the platform may receive or display data, content, or results from third party APIs, integrations, or partners. Such third party data is provided “as is,” and we do not control, guarantee, or warrant its accuracy, completeness, timeliness, or continued availability. Assessment.com and its affiliates will not be liable for any loss, damage, or costs arising out of or related to lost, deleted, inaccessible, corrupted, or inaccurate data, whether originating from the platform itself or from any third party service or integration.

Sharing of Assessment and Survey Results with Inviting Parties: If you access or complete any assessment, test, survey, questionnaire, or similar instrument on or through the Assessment.com platform using a link, email invitation, access code, or other method provided by a company, school, organization, coach, or individual (collectively, an “Inviting Party”), you understand, accept, and agree that your responses and results may be shared with that Inviting Party and any authorized users acting on its behalf. The Inviting Party may determine which results you can see, how your results are used, and how long they are retained, and may combine your results with information it already holds about you. Any use of your information by an Inviting Party is governed by that party’s own policies and practices, not this Privacy Policy, and we are not responsible for, and disclaim all liability arising from, their use, handling, or disclosure of your information. If you choose not to create or register an account with Assessment.com, you may not be able to view your results, access detailed reports, or maintain a record of assessments you have taken on the platform, even though the Inviting Party may still have access to your responses and results.

Anonymized Data for Research and Improvement: We may use your MAPP or other assessment responses and results, in anonymized or aggregated form, to help us better understand how people use our assessments and to improve the Assessment.com platform. Before using data this way, we remove personal identifiers like your name, email address, and account details so that the information cannot reasonably be linked back to you. We use this anonymized data to refine our scoring models, build and update comparison groups and norms, test new features, and conduct internal research. Anonymized data does not identify you personally and may be kept and used by us for these purposes over time.

  1. INTELLECTUAL PROPERTY

All content and materials provided by Assessment.com, including but not limited to text, graphics, software, and trademarks, are owned by or licensed to us and are protected by intellectual property laws and are not to be copied, distributed or duplicated without written permission.

You may not copy, reproduce, distribute, or create derivative works without our express written permission.

  1. DISCLAIMERS

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or utility of any results generated by the assessment published on assessment.com regardless if published by third party or our own Assessments.

We do not offer medical, psychological, or legal advice.

  1. AI TOOLS DISCLAIMER: The Assessment.com platform may provide access to artificial intelligence tools, including but not limited to AI powered assessment builders, AI assistants, and automated recommendations (collectively, “AI Tools”). All content, suggestions, interpretations, reports, and other outputs generated by the AI Tools are provided solely for informational purposes and are not guaranteed to be accurate, complete, or suitable for any particular purpose. AI generated outputs do not constitute legal, medical, psychological, financial, career, or other professional advice, and should not be relied upon as a substitute for your own judgment or consultation with a qualified professional. You are solely responsible for reviewing, validating, and deciding whether and how to use any AI generated content, and for all outcomes that result from your use of such content. Assessment.com and its affiliates disclaim all liability arising from or related to your use of the AI Tools and any decisions or actions you take based on AI generated outputs, which are provided “as is” and “as available,” without any warranties of any kind, whether express or implied.

Marketing Communications: By creating an account on the Assessment.com platform or providing your email address, you consent to receive emails from Assessment.com and its affiliates, including service related messages, account updates, special offers, promotions, and information about products and services that may be relevant to you, such as assessments, coaching, courses, and related career or personal development resources. We may also send you occasional surveys or invitations to provide feedback. You can opt out of promotional emails at any time by using the unsubscribe link included in those communications or by updating your communication preferences in your account settings. Please note that even if you opt out of promotional emails, we may still send you non marketing messages related to your account or use of the platform.
  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Assessment.com and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages.

Our total maximum liability to you for any claims arising out of or related to the use of the Service is limited to the amount you paid us, if any, in the three (3) months preceding the event giving rise to the claim.

  1. THIRD-PARTY CONTENT AND LINKS

Our platform may contain links or access to third-party websites, services, or content. These are provided for convenience only. We do not endorse and are not responsible for the practices or content of these third parties.  Visiting those sites is voluntary, at will and by no means required.

  1. TERMINATION

We reserve the right to suspend or terminate and block your access to the Service at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users.

  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Assessment.com and its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, or expenses arising from:

  • Your use or misuse of the Service;
  • Your violation of these Terms;
  • Your violation of the rights of any third party.
  1. MODIFICATIONS

We may amend, update, or revise these Terms at any time, in our sole discretion, by posting the revised version on the Service or by otherwise notifying you. It is your responsibility to review the Terms periodically. Any changes will become effective immediately upon posting. Your continued access to or use of the Service after any modification constitutes your binding acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
